Oxbow residents in limbo, worried about latest legal challenges

OXBOW, ND. (KFGO-AM) - Oxbow Mayor Jim Nyhof told a room packed with concerned homeowners Monday night his community has sat back long enough and it's time to go on the offensive.

Nyhoff and residents are upset by claims from opponents of the F-M diversion that a federal judge's order to stop construction of the ring dike protecting Oxbow also includes homes under construction or being planned to replace those being bought out to make way for the dike.

Nyhof says he and the Diversion Authority thought the temporary injunction was clear, the order covered only levee work and are now waiting for clarification from the judge. He says the uncertainty has left homeowners and homebuilders in limbo. He told everyone to contact elected officials. Nyhof has also asked to meet personally with Governor Jack Dalrymple. "We need to go to them full force with the same message, we are being harmed."

Jeff and Lonnie Pederson are among several dozen property owners not knowning what to do next. They've been waiting to start construction on their new home. He calls it a been a roller coaster,"very frustrating and traumatic."
