MOORHEAD, Minn. (KFGO-AM) - Clay County prosecutors have been dealt a major victory in the case of two hockey players accused of making a sex video with a 15 year-old girl.
Judge Michael Fritz has denied motions to dismiss the charges against Thomas Carey and Brandon Smith.
Defense attorneys claimed the cases should be dismissed for several reasons including selective prosecution, abuse of prosecutorial discretion and freedom of speech.
Carey and Smith are accused of making the video in a Moorhead motel room. They're charged with using a minor in a sexual performance and possession and distribution of child pornography.
