FARGO (KFGO-AM) -- A second jury will likely consider the sexual misconduct case against West Fargo High School english teacher Aaron Knodel.
The prosecution will ask for a mistrial, which would most likely be have to be approved by the judge.
The development came after a member of the 12-person jury was taken to a Fargo hospital by ambulance. She was disoriented when she reported for continued deliberations Wed. morning, didn't recognize her sister at the hospital and may not have disclosed that she had been a prior sexual abuse victim.
The 11 remaining members of the jury told the judge that they had voted to find Knodel "not" guilty on three of the five felony counts and had not yet decided on the two other charges.
The attorney general's office, which is prosecuting the case, has 14 days to prepare a formal request for a mistrial.
Knodel is accused of having a sexual relationship with a female student six years ago. He was suspended without pay last fall.
