FARGO (AP) - A federal judge has rejected an appeal by a man convicted of killing his former baby sitter.
Michael Gianakos of Moorhead is serving a life sentence for the 1997 death of 22-year-old AnneMarie Camp, of Fargo. Prosecutors say she was killed because she knew about a motel robbery Gianakos and his wife had staged.
Gianakos claimed in a complaint filed last month that the jury convicted him of murder rather than the charged crime, which was kidnapping resulting in death. He says that makes the indictment invalid and he should be set free.
U.S. District Judge Ralph Erickson says the appeal is frivolous because Gianakos should have raised the issue with the 8th U.S. Circuit Court of Appeals.
