MOORHEAD (KFGO-AM) Despite concerns from some Moorhead city leaders about whether it's legal, the City Council approved a memorandum of understanding for the proposed F-M Diversion Project.
Project sponsors are required to sign the agreement in order to allow work to proceed on parts of the Diversion prior to federal authorization. That includes construction of a ring dike around Oxbow, Hickson and Bakke, in the water staging area south of Fargo.
The Minnesota Department of Natural Resources says it may be unlawful. Council member Heidi Durand agreed. She asked council members to vote against the request and then seek a revised m-o-u that did not include the levees south of Fargo. City Attorney John Shockley said Moorhead was not part of the initial agreement to build the levee so it's not doing anything illegal.
The memorandum passed 4 to 3.
