FARGO (KFGO AM) -- Prosecutors in the case of a former North Dakota teacher of year accused of having a sexual relationship with a 17-year-old student in 2009 say they need more time to prepare for a second trial, should they ask for a retrial.
The first trial for West Fargo High School teacher Aaron Knodel ended abruptly in April following one juror's medical emergency while they were deliberating. A judge last week declared a mistrial and said Knodel could be retried on the two remaining counts of felony corruption or solicitation of a minor.
Prosecutors say in documents filed Monday that the June 23 trial date is a "simply unrealistic and unfair'' time frame. The state says it plans to ask that the trial be moved out of Fargo.
