FARGO (KFGO-AM) - The Fargo-Moorhead Diversion Authority is denying allegations that it ignored a federal judge's order to halt construction of the Oxbow-Hickson-Bakke ring levee.
Last week, opponents claimed that work on the levee continued--even after U.S. District Court Judge John Tunheim issued an injunction to temporarily stop the project.
The Diversion Authority says all "physical construction activities" on the levee have been suspended with the exception of work to stabilize slopes and drainage passes.
Opponents said "the pace of construction increased substantially" after the injunction was ordered. But in court documents, the Diversion Authority says any construction activity is being performed by private third parties who are not covered by the judge's order.
