MOORHEAD, Minn. (KFGO-AM) - Attorneys who represent two hockey players accused of making a sex video with a 15-year-old girl in Moorhead are calling the alleged victim a "sexual predator." Lawyers for 19-year-old Thomas Carey of Moorhead and Brandon Smith have asked a judge to dismiss the case for "abuse of prosecutorial discretion."
In court documents, Joseph Friedberg and Jade Rosenfeldt say the girl proudly calls herself a "puck slut", and was competing with an Iowa woman to have sex with players on every team in the United States Hockey League.
Clay County Attorney Brian Melton says the defense attorneys’ claims are "outrageous." In an interview with KFGO News, Melton called Rosenfeldt a “hired gun” and a “hatchet woman.” “It is truly abhorrent and disgusting” according to Melton.
Rosenfeldt said “It’s rather unfortunate that the Clay County attorney would feel the need to take it to a personal level.” Friedberg said “I’m absolutely shocked that the county attorney of a civilized county would stoop in response to a motion…and call somebody names.”
Carey and Smith are charged with using a minor in a sexual performance, possession of child pornography and distributing child pornography. Prosecutors say the video was made in a Moorhead motel room and was distributed to an unknown number of people.
