MOORHEAD, Minn. (KFGO AM) -- A district court judge is defending himself against accusations by prosecutors that in certain cases, he refuses to follow the law.
Last week, Clay County Attorney Brian Melton said Judge Steven Cahill ignored the law when he dismissed charges against two drunk drivers who refused to submit to blood-alcohol tests.
Cahill says even though the state Court of Appeals has upheld the "implied consent" law, the U.S. Supreme Court says blood tests require a search warrant.
County prosecutors say Cahill's actions have forced them to consider removing the judge from all similar cases.
Cahill says they have a right to exclude him -- and says he's not surprised by their actions.
