FARGO (KFGO-AM) -- The Minnesota DNR has told the Fargo-Moorhead Diversion Authority that it considers ring dikes for Oxbow, Hickson and Bakke part of the overall diversion project and it will not make any final approval for the entire diversion until the state's environmental impact analysis is completed.
At the same time, Asst. DNR Commissioner Mike Carroll says since the dikes would be entirely within North Dakota, it has no jurisdiction over construction of the levees.
Diversion opponents say they see it as a victory. But Diversion Authority chairman Darrell Vanyo says he and lawyers for the authority view it differently.
Vanyo says the DNR cites no legal reason to stop construction of the dikes.
