FARGO (KFGO-AM) - A Fargo advertising agency's lawsuit claiming that its traffic safety character "Talking Orange" was stolen by a California company has been dismissed in federal court.
H2M claimed a company called "Gagfilms" re-named the character "Annoying Orange" and used it on the Cartoon Network and in marketing agreements with major national retailers.
H2M also sued two former MSU-Moorhead film students who had access to H2M's original designs.
An order by U.S. District Judge Ralph Erickson dismissed the case with prejudice--and without costs or fees to anyone involved.
The case was scheduled to go to trial in June.
