ND Supreme Court won't rehear medical abortion case

BISMARCK (AP) - The North Dakota Supreme Court will not reconsider its earlier ruling that limits the use of pregnancy-terminating drugs.

Lawyers for North Dakota's abortion clinic in Fargo had asked the court to clarify part of the ruling.

In a divided decision released Oct. 28, the five justices said the 2011 state law that bars the use of one of two drugs used by the clinic in medication abortions didn't violate the North Dakota Constitution.

The court wrote that the law was not an outright ban on all medication abortions. But the Red River Women's Clinic argued that the law's "practical effect'' is a ban because the procedure cannot be performed without both drugs.
