Defense wants exhibits kept open in hockey sex video case

MOORHEAD, Minn. (KFGO-AM) - Attorneys for two hockey players accused of making a sex video with a teenage girl in Moorhead are firing back at prosecutors for trying to block public access to court documents.

The Clay County attorney's office wants a judge to seal exhibits in the case involving Thomas Carey and Brandon Smith. They claim the defense has been filing frivolous documents in an effort to get around a gag order.

Defense attorneys say that preventing their clients from publicly arguing their case is a "grave matter" that would violate their right to a fair trial. In court documents.  Attorney Joseph Friedberg says some elements of the case may be perceived to be scandalous, but he says prosecutors do not have the right to "shield the cleansing light of the public" from the case.

Carey and smith are charged with using a minor in a sexual performance, and possession and distribution of child pornography. Their next court appearance is scheduled in January.
