MOORHEAD, Minn. (KFGO-AM) - Prosecutors are attempting to block access to public court documents in the case of two hockey players accused of making a sex tape with a teenage girl.
Assistant Clay County Attorney Pam Harris is accusing defense attorneys of trying to circumvent a gag order by filing exhibits, so they're readily accessible to the public and media. Harris's motion claims many of the defense's filings are "objectionable" because the exhibits could be seen by the public before prosecutors had a chance to object.
Harris is asking a judge to seal the exhibits and prohibit further exhibits from being filed until a hearing next month.
"Neither side really wants to try their case in the media," according to Fargo attorney and former Cass County prosecutor John Goff. "To ask to completely close and seal all the filings I think, would need some strong and compelling interest because it's a public proceeding and people have a right to know what's goin on."
Thomas Carey and Brandon Smith are charged with using a minor in a sexual performance, possession of child pornography and distributing child pornography.
