FARGO (KFGO-AM) - Lawyers who represent two Fargo women challenging North Dakota's same-sex marriage ban hope some recent federal appeals court rulings bolster their chances of a victory.
Jan Jorgensen and Cindy Phillips were legally married in Moorhead.
The women's attorneys recently filed arguments citing federal appeals court rulings that overturned same-sex marriage bans in other states. They also argue that because the U.S. Supreme Court decided not to hear appeals from states that want to prohibit gay marriage, bans in those states are unconstitutional.
Jorgensen and Phillips are represented by the national gay rights group "Lambda Legal."
