MOORHEAD (KFGO-AM) - Cass County Adminstrator Keith Berndt has been aquitted by a Clay County Jury.
After deliberating about 4 hours, the jury found Berndt not guilty on two misdemeanor assault charges. He was accused of of assaulting his girlfriend's son after a Super Bowl party.
The then 13-year-old boy said Berndt pushed him into a bedframe, breaking it, then punched him and kicked him.
Berndt took the stand and said he never physically harmed the boy.
Jade Rosenfeldt, Berndt's attorney said "there was problems with the state's case...there were certain things the state couldn't explain and I think ultimately the jury probably found that the state could not prove their case beyond a resonsable doubt."
The Clay County prosecutor declined comment.
