BRECKENRIDGE, MINN. (KFGO-AM) A second lawsuit has been filed against the F-M Diversion project by the Richland-Wilkin Joint Powers Authority.
The J-P-A, made up of several dozen upstream opponents of the proposed $2 billion project is seeking to halt construction of a dike that's part of the Diversion. The J-P-A claims construction of the dike to protect Oxbox, Hickson and Bakke south of Fargo violates Minnesota law because not all necessary permits and reviews are complete. The suit says construction or permitting the ring dike would cost $70 million that could be used to pay for mitigation efforts that would avoid flooding in Wilkin county.
A lawsuit the J-P-A filed in August of 2013 challenges the entire project claiming it would have "devastating impacts" to area's south of Fargo-Moorhead.
